For DMCA purposes, the jurisdiction statement is not simply consent to the courts of England and Wales.

Under the DMCA, the required statement generally concerns consent to the jurisdiction of the appropriate United States Federal District Court. If the person submitting the counter-notice is outside the United States, the applicable DMCA wording generally concerns a U.S. federal judicial district in which the relevant service provider may be found.

The person submitting the counter-notice must also agree to accept service of process from the party that submitted the original DMCA notice, or that party's agent, where required by law.

16. Restoration Following a DMCA Counter-Notice

Where the formal DMCA counter-notification process legally applies and Pets Tails is acting as a qualifying service provider under that framework, the applicable statutory procedures and timeframes will be followed.

Under the DMCA framework, qualifying service providers generally restore or cease disabling access to the relevant material not less than 10 and not more than 14 business days after receiving a valid counter-notification, unless the original complainant provides notice that appropriate court proceedings have been commenced to prevent the alleged infringement.

This 10–14 business-day process applies specifically to the relevant U.S. DMCA procedure and should not be interpreted as a general deadline applying to every UK copyright complaint.

17. Disclosure of Notices and Counter-Notices

Where reasonably necessary to investigate or resolve a copyright complaint, information contained in a notice or counter-notice may be shared with:

The person who supplied the disputed material
The copyright owner or complainant
Relevant service providers
Professional advisers
Courts, regulators, or public authorities where legally required

If you submit a copyright notice or counter-notice, you should therefore understand that some information you provide may need to be disclosed to another party involved in the dispute.

18. No Determination of Copyright Ownership
